  一、劳动合同原文样本:
 
  根据《中华人民共和国劳动法》和中国其他有关法律、法规, (以下简称甲方)和 (以下简称乙方),在平等、自愿及相互协商之基础签订本合同,并共同遵守本合同所列条款。
 
  1合同类别和期限
 
  1.1本合同为固定期限的劳动合同。
 
  1.2本合同期限为 年。自 年 月 日起至 年 月 日止。
 
  2工作内容
 
  2.1 乙方自愿受聘于甲方。乙方同意根据甲方工作需要,担任甲方 职位。
 
  3双方的权利和义务
 
  3.1 甲方的权利
 
  (1)按照岗位责任组织管理,检查考核乙方完成(工作)任务;
 
  (2)按照国家法律、法规和本单位有关规定,决定对乙方劳动报酬的分配形式,并对乙方实施奖励和处分;(北京翻译  推荐整理)
 
  (3)根据甲方本身业务需要,在乙方专业知识和技能范围内,对乙方的工作岗位进行调整;
 
  (4)甲方根据经营管理的需要,有权随时合理地修订其规章制度。并可用其认为恰当的任何方式(包括但不限于通知、通告、电子邮件、备忘录和员工手册等)通知乙方;
 
  (5)当乙方不履行本合同时,甲方有权按第8条规定解除合同。
 
  (6)当乙方违反本合同规定的义务,甲方有权依据当地法律及甲方规章制度追究责任。
  3.2 甲方的义务
 
  (1) 按照有关劳动安全,劳动保护、职业安全等的规定,向乙方提供必需的安全健康的工作环境,同时为乙方能够完成本合同规定的义务提供相应的工作条件;
 
  (2) 根据有关中国国家有关规定及本合同有关条款,按时支付乙方劳动报酬并提供保险福利待遇;成绩证明书案例:
 
  (3) 甲方每年组织乙方进行一次健康检查。
 
  3.3乙方的权利
 
  (1)按照规定领取报酬和享受相关的保险福利待遇;
 
  (2)享受业务(技术)学习(培训)机会;
 
  (3)享有休息、休假和获得劳动安全卫生保护的权利;
 
  (4)甲方不履行本合同时,乙方可以依据本合同第8条约定解除;
 
  (5)甲方违反合同约定时,乙方有权依法向劳动争议仲裁委员会提起申诉。
  3.4 乙方的义务
 
  (1)在工作期间内,将全部精力投入到岗位职责所要求的各项义务中,还应完成甲方为其安排的本岗位以外的临时性工作,尽最大努力协助甲方达到或超出预期的商业计划;
 
  (2)遵守国家法律、法规和社会公德,保守甲方的技术秘密和商业秘密,爱护甲方财物;
 
  (3)遵守甲方规定的劳动纪律、操作规程和内部规章制度,遵守职业道德;
 
  (4)努力学习专业知识,不断提高业务能力,以胜任本岗位工作。
 
  4.工作时间甲方根据国家法律、法规和本单位的工作实际,实行每周五天工作日,每日工作时间8小时,平均每周工作时间不超过40小时。
 
  5.劳动报酬
 
  5.1 甲方支付乙方的薪金由工资和津贴两部分构成。其中工资又分为基础工资、岗位工资和浮动工资三部分。甲方根据乙方的学历、工龄、技能和岗位职责确定乙方的工资标准。
 
  5.2依照甲方的经济效益和乙方的工作业绩确定乙方的奖金金额。发放形式、时间、标准由甲方根据内部规章制度确定。
 
  5.2甲方每月月底将报酬金额划入乙方指定的银行个人工资账户中。

  2 Job Description
 
  2.1 Party A voluntarily accepts the appointment of Party A to be Party A’s _________ according to the requirements of Party A’s job.
 
  3 Rights and Obligations of Both Parties
 
  3.1 Rights of Party A
 
  (1) to conduct organization and management as well as inspect and examine the task (work) finished by Party B according to post responsibilities;
 
  (2) to decide on the form of distribution of Employment Contract remuneration for Party B and give awards as well as punishments to Party B subject to relevant provisions of laws and regulations as specified by the state and those formulated by this unit;
 
  (3) to make adjustment to Party B’s job in consideration of the professional knowledge and skills of Party B according to the requirements of Party A’s own businesses;
 
  (4) to be entitled to revise Party A’s rules and regulations from time to time by Party A according to the requirements of its operation and management, and to inform Party B of matters (including but not limited to any notice, announcement, email, memorandum and employee manual) by any means deemed appropriate by Party A;
 
  (5) to have the right to terminate this Contract pursuant to Article 8, should Party B fail to perform this Contract; and
 
  (6) to enjoy the right to investigate Party B for responsibility in compliance with local laws as well as Party A’s rules and regulations in case Party B contravenes its obligations hereunder.
  3.2 Obligations of Party A
 
  (1) to provide Party B with necessary, safe and healthy working environment according to relevant provisions on Employment Contract safety, Employment Contract protection and occupational safety, and to furnish corresponding working conditions for Party B to fulfill its obligations hereunder at the same time;
 
  (2) to Party B the Employment Contract remuneration on time and provide Party B with insurance benefits in conformity with relevant provisions stipulated by the State and pertinent terms and conditions hereof; and
 
  (3) to organize a medical examination on a yearly basis for Party B.
 
  3.3 Rights of Party B
 
  (1) to collect remuneration and enjoy pertinent insurance benefits according to provisions;
 
  (2) to enjoy opportunities of vocational (technology) study (training);
 
  (3) to have the rights of enjoying rest and holidays as well as acquiring the protection of Employment Contract safety and health;
 
  (4) to have the right to terminate this Contract in accordance with Article 8 in the event that Party A fail to perform this Contract; and
 
  (5) to be entitled to legally file an application for arbitration before an arbitration commission of Employment Contract disputes if Party A contrives this Contract.
 
  3.4 Obligations of Party B
 
  (1) to finish temporary work assigned by Party A in addition to Party B’s own job and give assistance to Party A in realizing or going beyond intended business programs to the best of abilities of Party B, besides putting whole soul into various obligations required by post responsibilities;
 
  (2) to observe laws and regulations stipulated by the State social ethics, keep confidential Party A’s technological know-how and business secrets and protect Party A’s property;
  (3) to comply with Employment Contract disciplines, operating instructions and internal rules as well as regulations and adhere to professional ethics; and
 
  (4) to study hard the professional knowledge, keep improving professional ability so as to be equal to its own job.
 
  4 Working Hours
 
  The working hours that Party B is required to follow by Party A in accordance with State laws and regulations as well as the actual conditions of this unit is five days a week, with 8 eight hours each day and no more than 40 hours in all for a week.
 
  5 Employment Contract Compensation
 
  5.1 The salary paid by Party A to Party B shall be composed of such two parts of wages and allowances. Such wages shall be divided into three parts like basic wage, job wage and floating wage. Party A shall, according to the educational background, length of service, skills and post responsibilities of Party B, determine the standards of wages paid to Party B;
 
  5.2 The amount of bonus for Party B shall be decided according to Party A’s economic returns and the job performance of Party B. Party A shall, based on the internal rules and regulations, make decision on the forms, time, standards of bonus distribution;
